Terms of Service

1. Service description
Eva provides SMS appointment reminders and cleaning service notifications to clients of women-led service businesses. Messages include appointment confirmations, reminders, completion notifications, review requests, and status updates such as "on my way" or rescheduling alerts. The service is operated by Stephane BACANIN (Entrepreneur individuel), SIREN 949 493 753, registered in France.
2. Message frequency
Message frequency varies based on your booking activity. You typically receive up to 6 messages per appointment (confirmation, reminders, an on-my-way notice, a completion notice, and a review request). Frequency is higher during busy periods with several appointments and minimal when you have no scheduled services. Eva only sends transactional messages tied to a real, scheduled appointment, never promotional or marketing SMS.
3. Charges and data rates
Eva does not charge recipients directly for SMS messages. Standard messaging rates apply according to your mobile carrier plan. International SMS rates may apply if you are outside the United States. International SMS rates may be significantly higher than domestic rates depending on your carrier and location. You are responsible for any carrier charges incurred. There are no refunds for SMS messages once sent.
4. Opt-in
You opt in to SMS by checking the dedicated, optional SMS consent box on the booking form before submitting it. The box is unchecked by default, so submitting the form without checking it does not opt you in, and no SMS is sent. Your consent is recorded with a timestamp. You can opt out at any time by replying STOP, and opt back in by replying START.
5. Opt-out
You may cancel SMS messages at any time by replying STOP to any message. Your unsubscribe request will be processed within 4 hours. You will receive a single confirmation message. After opting out, no further SMS messages will be sent unless you provide renewed consent.

7. Third-party processors
SMS messages are delivered through Twilio Inc., a US-based communications platform acting as our data processor under a written agreement. Twilio handles message transmission and may maintain delivery logs on US servers.
8. Governing law
These terms are governed by the laws of France, including regulations enforced by the CNIL (Commission Nationale de l'Informatique et des Libertés) and applicable GDPR provisions. Any disputes shall be subject to the jurisdiction of French courts.
9. Refunds
SMS messages cannot be recalled, retracted, or refunded once transmitted. By using this service, you acknowledge that message delivery is final.
10. Limitation of liability
Eva is not liable for failed, delayed, or undelivered SMS messages caused by carrier network issues, technical failures, or circumstances beyond our reasonable control. Our maximum liability for any claim arising from SMS services is limited to the fees paid for the specific message(s) in question. We make every reasonable effort to ensure message accuracy but are not liable for typographical errors or content mistakes.
11. Message accuracy
We do our best to ensure all appointment details, times, and service information are accurate. However, we are not liable for occasional typos, scheduling errors, or inaccuracies in message content. Please confirm critical appointment details directly with your service provider if you have any doubt.
12. Policy updates
We may update these terms and our privacy policy from time to time to reflect changes in our service, legal requirements, or other factors. Changes are effective upon publication on this page. Your continued use of Eva's SMS service following any updates constitutes your acceptance of the updated terms.
