Affiliate Program Terms

These terms govern your participation in the Eva affiliate program (the "Program"). Eva is operated by Stephane BACANIN (Entrepreneur individuel), SIREN 949 493 753, registered in France. By applying to or participating in the Program, you agree to these terms. If you do not agree, do not participate.

1. Eligibility and approval

The Program is open to individuals and businesses whose audience includes US residential cleaning business owners, including creators, coaches, consultants, suppliers, and current Eva customers. Participation is by application and approval. We may accept or decline any applicant, and may suspend or remove any affiliate, at our discretion. You must be at least 18 years old and able to enter a binding agreement.

2. Your referral link

On approval you receive a personal referral link and may receive brand assets. You may share your link in your own content, newsletters, videos, courses, and personal recommendations. You may not represent yourself as Eva, as an employee of Eva, or as speaking on our behalf.

3. Qualified referrals

A referral qualifies for commission when a new customer you referred starts a paid Eva subscription after their free trial, and the first payment is successfully collected. Referrals are attributed by your referral link (tracked for the attribution window shown in your affiliate dashboard) and, where no link click is recorded, by a valid referral code or affiliate name the customer reports at signup. Where both exist, the most recent qualifying touch applies.

Customers you refer receive a 30-day free trial in place of the standard 14 days.

4. Commission

You earn 30% of each payment a referred customer makes to Eva for their first 12 months, starting from their first paid invoice. Commission is calculated on net amounts actually received by Eva, excluding taxes, and is earned only once a payment is successfully collected and clears any refund period. Commission applies to subscription payments only, not to one-time fees, taxes, or third-party charges.

5. Payouts

Approved commissions are paid monthly once your balance reaches the minimum payout threshold shown in your affiliate dashboard. Payouts are made by the method you select on approval, such as Stripe or PayPal. You are an independent contractor, not an employee, agent, or partner of Eva, and you are solely responsible for your own taxes. You agree to provide any tax forms we are required to collect (for example W-9 or W-8).

6. Clawbacks and adjustments

If a referred payment is refunded, charged back, or reversed, including under Eva's 30-day money-back guarantee, the related commission is reversed and deducted from your balance. We may also withhold or reverse commissions tied to fraud, abuse, or violations of these terms.

7. No self-referrals

You may not refer yourself, your own Eva account, or accounts you own or control, and you may not use your link to obtain a discount on your own subscription. Referrals must be genuine new customers.

8. Prohibited promotion

You may not: bid on Eva brand terms or close variants in paid search or run ads that impersonate Eva; use spam, unsolicited messaging, or misleading claims; post your link on coupon, deal, or cashback sites without our written permission; engage in cookie stuffing, forced clicks, or any artificial traffic; or make any promise, guarantee, or statement about Eva that is false or that we have not published. You must clearly disclose your affiliate relationship in line with FTC guidance (for example, label promotional content as an ad or affiliate link).

9. Term and termination

Either party may end participation at any time. On termination, you stop using your link and any Eva assets. We may withhold unpaid commissions if you have materially violated these terms. Sections on commission already earned, clawbacks, taxes, and liability survive termination.

10. Intellectual property

We grant you a limited, revocable, non-exclusive license to use Eva names and assets solely to promote Eva under these terms. All Eva trademarks and content remain ours. You may not modify our assets or use them in any way that harms the brand.

11. Changes to the Program

We may update these terms, commission rates, the attribution window, payout thresholds, or any part of the Program. Changes are effective on publication on this page or notice in your affiliate dashboard. Continued participation after a change means you accept it.

12. Limitation of liability

The Program is provided "as is." To the extent permitted by law, Eva is not liable for indirect or consequential losses, and our total liability for any claim arising from the Program is limited to the commissions paid or payable to you in the three months before the claim.

13. Governing law

These terms are governed by the laws of France, including applicable GDPR provisions and the CNIL (Commission Nationale de l'Informatique et des Libertés). Any disputes are subject to the jurisdiction of French courts.
